Without this license, driving with a suspended license puts you at serious risk of arrest, criminal charges, and even longer suspension periods. It is simply not worth the risk.

How Do You Get an Occupational Driver’s License in Texas?

Obtaining an ODL is a legal process that requires filing a civil court case—a type of mini-lawsuit. A judge must approve your request and issue an order to the Texas Department of Public Safety (DPS) directing them to provide the license.

Here is what you need to know about the process:

  • Timeline: Most occupational license cases can be resolved within 7 to 10 days.
  • County Requirements:
    • In Harris County, an ignition interlock device is typically required along with an in-person court appearance.
    • In Fort Bend County, the process is generally less restrictive and does not usually require an interlock device.
  • Driving Limits: You may be allowed up to 12 hours of driving time per day, depending on the judge’s discretion and your driving history.

What If You Have a Prior DWI or Hold a CDL?

If you have prior DWI convictions, expect stricter rules. The court may reduce the number of permitted driving hours or add extra conditions to your license.

Commercial driver’s license (CDL) holders should note that an ODL does not allow you to operate a commercial vehicle. If you are a CDL holder facing suspension, time is critical—you have only 15 days to contest an automatic suspension. Reach out to our office immediately to preserve your rights.
